4. SEU ÁUDIO É SEU

a) copiar, vender, alugar, sublicenciar, distribuir ou disponibilizar o Software ou o instalador a terceiros;
b) descompilar, desmontar, fazer engenharia reversa, extrair os modelos, as curvas ou o código, ou modificar o Software, salvo nos limites que a lei expressamente permitir;
c) remover ou alterar avisos de direitos autorais, créditos, marcas ou o aviso de marcas de terceiros;
d) burlar o aceite destes Termos ou qualquer mecanismo de proteção;
e) apresentar o Software ou o seu som como produto oficial de qualquer fabricante de microfones;
f) usar o Software para fins ilícitos.

6. PRIVACIDADE
O Software funciona localmente.

10. DISPOSIÇÕES GERAIS
10.1. Se alguma cláusula for considerada inválida, as demais permanecem em vigor.

TERMS OF USE AND END USER LICENSE AGREEMENT – SENIORMY VOICE
Version 1.0 – October 19, 2026

© 2026 W. Carolino, Brazilian individual microentrepreneur, CNPJ 69.610.819/0001-77 ("Owner"). All rights reserved.

By installing, opening or using SeniorMy Voice (the "Software"), including the application and the Audio Unit and VST3 plug-ins, and by ticking "I have read and accept the Terms of Use", you ("User") declare that you have read, understood and fully agree to these Terms. If you do not agree, do not install or use the Software.

1. ACCEPTANCE
1.1. The Software asks for acceptance of these Terms the first time it is opened on each computer. Until acceptance is given, audio passes through unprocessed.
1.2. Acceptance is recorded on the User's computer with the Terms version, date and time. When the Terms change, the Software will ask for acceptance again.
1.3. The User must be 18 or older, or be assisted by a legal guardian.

2. LICENSE
2.1. The Owner grants the User a personal, limited, revocable, non-exclusive and non-transferable license to install and use the Software on computers the User owns or controls.
2.2. The Software is licensed, not sold. The code, algorithms, microphone models, curves, presets, interface, icon, texts and the "SeniorMy" and "SeniorMy Voice" marks belong exclusively to the Owner and are protected by Brazilian Laws 9,609/1998 (Software), 9,610/1998 (Copyright) and 9,279/1996 (Industrial Property).

3. MICROPHONE EMULATIONS AND THIRD-PARTY TRADEMARKS
3.1. The Software's models are digital emulations created by the Owner from reference sound characteristics and published technical data. They are not reproductions, copies or official measurements of any physical microphone, and the sound may differ from the original equipment.
3.2. Sennheiser, Shure, Electro-Voice, Neumann, AKG, Sony, Royer and the model names mentioned (such as e835, SM58, SM7B, RE20, U 87 Ai, U 47, C414, C-800G, R-121 and KMS 105) are trademarks of their respective owners. They appear in the Software only to describe the reference sound ("inspired by"). The Owner and the Software have no affiliation with, sponsorship, authorization or endorsement from these manufacturers.
3.3. The models' own names (such as "SM Live 835" and "SM Studio 87") belong to the Owner.

4. YOUR AUDIO IS YOURS
4.1. Recordings, voices, music and other content processed in the Software ("User Content") belong to the User. The Owner claims no rights over them, and the User may use them in commercial or non-commercial productions without paying royalties to the Owner.
4.2. The User is solely responsible for holding the rights to everything recorded or processed in the Software and is liable for any infringement of copyright, related, voice or image rights.

5. RESTRICTIONS
Without the Owner's prior written permission, it is forbidden to:
a) copy, sell, rent, sublicense, distribute or make the Software or its installer available to third parties;
b) decompile, disassemble, reverse engineer, extract the models, curves or code, or modify the Software, except to the extent the law expressly permits;
c) remove or alter copyright notices, credits, trademarks or the third-party trademark notice;
d) circumvent the acceptance of these Terms or any protection mechanism;
e) present the Software or its sound as an official product of any microphone manufacturer;
f) use the Software for unlawful purposes.

6. PRIVACY
The Software runs locally. It does not collect, store off the computer or transmit the User's personal data or audio. The acceptance record stays only on the User's computer.

7. NO WARRANTY
The Software is provided "as is", under development, and may contain errors. There is no warranty of uninterrupted operation, compatibility with any operating system, computer, audio interface, DAW or plug-in, or fitness for a particular purpose. The User is responsible for backing up projects and recordings and for setting volume levels that protect their hearing and equipment.

8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Owner is not liable for indirect or incidental damages, lost profits or revenue, loss of data, projects or recordings, interruption of work or performances, or damage to equipment or hearing arising from the use of or inability to use the Software. Should any liability be recognized, it is limited to the amount actually paid by the User for the license, if any. Nothing in these Terms excludes rights granted by Brazilian Law 8,078/1990 (Consumer Protection Code), where applicable.

9. UPDATES AND TERMINATION
9.1. The Owner may change, update or discontinue the Software and these Terms at any time. A new version of the Terms will be shown in the Software and must be accepted to continue using it.
9.2. The license ends automatically if these Terms are breached, and the User must uninstall and delete all copies, without prejudice to applicable civil and criminal measures. Intellectual property and liability obligations survive termination.

10. GENERAL
10.1. If any clause is held invalid, the others remain in force.
10.2. Tolerance of any breach does not constitute a waiver of rights.
10.3. Where these Terms exist in other languages, the Portuguese version prevails.
10.4. These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Taboão da Serra/SP, Brazil, are elected to settle any dispute, without prejudice to the consumer's right to file suit in their place of residence.
